Eligibility

Telehealth Initial Certifications — HB 1203 (2025)

After 2025 HB 1203, telehealth is now permitted for initial evaluations — previously, only renewals could be done remotely. This change is critical for patients in rural counties (Williston, Bowman, etc.) where no in-person providers were certifying as of 2025.

Designated Caregivers

Per § 19-24.1-04: caregivers must be ≥21, pass background checks (no felony or recent drug-related misdemeanor convictions), and may assist no more than five qualifying patients. Caregivers are not charged an application fee.

Out-of-State Reciprocity

None for in-state purchase. Non-resident applicants may obtain a 60-day electronic North Dakota medical card under SB 2294, but North Dakota does not honor cards issued by other states, and a North Dakota card may or may not be accepted in other states under reciprocity rules.

Possession and Purchase Limits

Per registry card type (cancer "Enhanced" patients have higher allowances):

  • 30-day purchase: 2.5 oz dried flower (cancer 6 oz); 6,000 mg combined THC concentrates; 310 mg THC edibles.
  • Possession at any time: up to 7.5 oz flower; up to 500 mg edibles; 1 g per concentrate container.
