North Dakota Purchase & Possession Limits

Patient purchase per 30 days: 2.5 oz dried flower (cancer/Enhanced 6 oz); 6,000 mg combined THC across concentrate and cannabinoid products; 310 mg THC in cannabinoid edibles (HB 1203). Possession at any time: up to 7.5 oz flower; up to 500 mg edibles; up to 1 g per concentrate container (SB 2293). Home cultivation prohibited regardless of patient status (2017 SB 2344 strip).

30-Day Purchase Limits

  • Dried flower: 2.5 oz per 30 days (standard adult patient).
  • Cancer "Enhanced" patients: up to 6 oz of dried flower per 30 days.
  • Combined THC concentrate / cannabinoid products: 6,000 mg combined per 30 days.
  • Cannabinoid edibles: 310 mg THC per 30 days (HB 1203, August 1, 2025).

Possession Limits at Any Time

  • Edibles: up to 500 mg at any time.
  • Concentrate containers: 1 g maximum per individual container (SB 2293).

The "3 oz" possession figure cited in older guides predates the 2021 HB 1417 flower-addition reforms and SB 2293’s 2025 updates.

Home Cultivation Prohibited

No exception exists for any patient class. Unauthorized cultivation is charged as a felony under § 19-03.1-23. The original 2016 Measure 5 home-cultivation provision (≥40 mi from dispensary) was stripped by 2017 SB 2344 and has not been restored.

Pediatric (Zero/Minor) Patients

  • Limited to products at ≤6% THC concentration.
  • Cannot purchase flower.
  • Designated caregiver (typically parent/legal guardian) handles purchases on behalf of minor patient.

Cancer "Enhanced" Patients

Patients with cancer diagnosis qualify for "Enhanced" registry status, which extends the 30-day flower purchase to 6 oz (vs. standard 2.5 oz). Healthcare provider certification of cancer diagnosis required.

Comparison to Neighboring Programs

  • Minnesota: adult-use legal since 2023; possession 2 oz flower / 8 g concentrate (no patient framework needed).
  • Montana: adult-use legal since 2022; possession 1 oz flower / 8 g concentrate.
  • South Dakota: medical only; 3 oz flower max possession.
  • Manitoba/Canada: federally legal; 30 g possession limit.

ND’s 30-day purchase limits and possession caps are mid-range for medical-cannabis programs nationally and substantially constrained relative to neighboring adult-use programs.
